The use of the Iberbrain Platform is subject to the reading and acceptance of these Terms and Conditions.

These Terms and Conditions should be read together with the Privacy Policy and the Cookie Policy of the Iberbrain Platform. Further information regarding Cookies and Similar Technologies is available in the Iberbrain Platform Cookie Policy.


Welcome to the Iberbrain Platform

Thank you for choosing our Platform.

The Iberbrain Platform is an independent digital solution dedicated to cognitive activation through movement, rhythm, cognition, creativity, and structured multisensory experiences.

Our mission is to make cognitive activation more accessible, engaging, and scalable, helping people of all ages improve focus, coordination, cognitive performance, and well-being throughout life.

These Terms and Conditions explain the rules for accessing and using the Platform, as well as the rights and responsibilities of both the Iberbrain Platform and its users.

By accessing or using the Platform, you confirm that you have read, understood, and accepted these Terms and Conditions. If you do not agree with these Terms, you must refrain from using the Platform.


Our Principles

Everything we develop at the Iberbrain Platform is guided by five core principles:

• Accessibility;

• Cognitive Well-being;

• Scientific Responsibility;

• Privacy and Security;

• Respect for Intellectual Property.

These principles shape every programme, feature, and service available through the Platform.


Definitions

For the purposes of these Terms and Conditions:

• Platform — means the Iberbrain Platform web application, future mobile applications, future desktop applications, and all related digital services. The Platform does not include the Iberbrain public website, which is governed by its own separate Terms and Conditions, Privacy Policy, and Cookie Policy.

• User — means any individual or organisation authorised to use the Platform.

• Content — means all text, graphics, photographs, illustrations, videos, audio recordings, tutorials, exercises, programmes, documentation, and other materials available through the Platform.

• Programme — means a structured learning, cognitive activation, or educational pathway available within the Platform.

• Module — means an individual area or collection of content that may be assigned to a user.

• Services — means all digital services provided through the Platform.


1. About the Iberbrain Platform

The Iberbrain Platform is an independent digital solution dedicated to cognitive activation through movement. It combines movement, rhythm, cognition, creativity, and structured multisensory experiences designed to stimulate the brain and promote attention, memory, coordination, adaptability, well-being, and lifelong learning.

The Platform currently includes, among other features:

• Programmes based on the Ronnie Gardiner Method® (RGM);

• Creativity programmes;

• Brain challenges;

• Guided cognitive activation sessions;

• Educational resources;

• Video tutorials;

• Audio guidance;

• Digital, hybrid, and on-site programmes.

The Iberbrain Platform is designed for individual users as well as institutional clients, including companies, schools, healthcare institutions, rehabilitation centres, senior care organisations, activity centres, and other professional environments.

The Platform continuously evolves, and new programmes, modules, technologies, and services may be introduced over time.


2. How the Platform Works

The Iberbrain Platform is a curated, access-controlled digital environment. Unlike platforms that allow unrestricted self-registration, access to the Iberbrain Platform is managed directly by its administration to ensure an appropriate experience tailored to each user's profile.

User accounts are created manually following an internal approval process. Once an account has been created, the administration assigns programmes, modules, and permissions according to the user's profile, institutional agreement, or authorised access level.

Not every user has access to the same programmes or functionality. Depending on the authorised access, users may participate in guided cognitive activation sessions, educational programmes, creativity activities, brain challenges, or access multimedia learning resources.

Some programmes may include audiovisual content hosted by external platforms such as YouTube or Vimeo, integrated solely to support the overall user experience.


3. Acceptance of these Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and accepted these Terms and Conditions.

If you access the Platform on behalf of a company, school, healthcare institution, or any other organisation, you declare that you have the legal authority to accept these Terms on behalf of that entity. If you do not agree with any provision of these Terms, you must discontinue use of the Platform immediately.


4. Eligibility

The Platform may be used by individual users and authorised organisations (companies, educational institutions, healthcare organisations, rehabilitation centres, senior care organisations, and activity centres).

Users agree to comply with all applicable laws within the jurisdiction where they use the Platform. Where required by law, minors may only use the Platform under the direct supervision of a parent, legal guardian, teacher, or other responsible adult. Certain programmes may also require supervision by qualified professionals depending on their intended use and the participant profile.


5. User Accounts

Access to the Platform is controlled exclusively by the administrator of the Iberbrain Platform. The Iberbrain Platform does not provide an automatic public account registration system. Accounts may be created following a direct request submitted through the Platform, an institutional agreement, or an authorised invitation.

The creation of an account remains entirely at the discretion and decision of the administrator of the Iberbrain Platform. The administrator reserves the right to approve, refuse, suspend, or terminate any access whenever reasonably necessary to protect the Platform, its users, or its legitimate interests.


6. Authentication

To protect user accounts and ensure the security of the Platform, a passwordless system based on temporary verification codes sent via email is used.

When signing in, users receive a temporary verification code at the email address associated with their account. This verification code is valid for a limited period only, must remain strictly confidential, and must not be shared with third parties. Users are responsible for maintaining secure access to their registered email address and for protecting it against unauthorised access. If users suspect that their account has been accessed without authorisation, they must notify the administrator of the Iberbrain Platform without undue delay.


7. Programmes, Modules and Permissions

The Iberbrain Platform provides access to different programmes, modules, and digital resources according to each user's authorised profile. Consequently, the programmes, content, and functionality available may differ between users.

The assignment of programmes and permissions is managed exclusively by the administrator. Access to one programme does not automatically grant access to other programmes, modules, or future content. The administrator reserves the right to create, modify, update, or remove programmes, modules, content, services, and technologies as the Platform evolves.


8. User Responsibilities

Users agree to use the Platform responsibly, ethically, and in accordance with these Terms and Conditions. Users are responsible for providing accurate information where requested, maintaining the confidentiality of their authentication credentials, using the Platform only for its intended purposes, and complying with all applicable laws and regulations.

Institutional entities (schools, care homes, clinics, etc.) are solely and exclusively responsible for obtaining all necessary consents (including from parents, legal guardians, or tutors) for the enrollment and participation of their users/students in the Platform, as well as for supervising the physical execution of all activities.


9. Acceptable Use and Display Limits

Users must not:

• Copy, reproduce, or redistribute Platform content without prior written permission;

• Modify, decompile, or reverse engineer the Platform;

• Attempt to gain unauthorised access to systems or data;

• Use automated tools or artificial intelligence to extract, collect, or scrape Platform content;

• Use the Platform for unlawful, fraudulent, or abusive purposes.

Unless otherwise specified in a commercial agreement that explicitly permits group display or institutional use, all granted licences are strictly for individual use. Failure to comply with these rules will result in temporary suspension or permanent termination of the user account.


10. Intellectual Property

Unless otherwise stated, all intellectual property rights relating to the Platform are owned by the creator of the Iberbrain Platform or are used under valid licences. This includes, without limitation: software, source code, user interface design, platform layout, graphics, illustrations, icons, animations, exercises, educational programmes, documentation, original videos, original audio recordings, tutorials, texts, databases, logos, and trademarks owned by the creator of the Iberbrain Platform.

Users receive a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform content in accordance with these Terms and Conditions. No ownership rights are transferred to users. Users may not reproduce, distribute, sell, modify, publish, or commercially exploit any Platform content without prior written permission from the administrator or the respective rights holder.


11. Ronnie Gardiner Method® (RGM)

Certain programmes available through the Platform are designed to support the practice of the Ronnie Gardiner Method® (RGM). The designations Ronnie Gardiner Method® and RGM®, as well as their associated elements, constitute intellectual property belonging to their respective owners and are protected by applicable trademark and copyright laws. The administrator of the Iberbrain Platform fully recognises and respects these rights.

The Platform is an independent digital solution designed to support cognitive activation through structured movement-based experiences and may include programmes developed in accordance with the principles of the Ronnie Gardiner Method®, where authorized and appropriate. Nothing within the Platform shall be interpreted as claiming ownership over the Ronnie Gardiner Method®, its trademarks, or associated intellectual property.

The Iberbrain Platform does not issue official certifications on behalf of the Ronnie Gardiner Method®. Users and professionals remain solely responsible for ensuring that any professional application of the Method complies with the certification, licensing, or authorization requirements applicable in their respective countries.


12. Audiovisual Content and Third-Party Services

To enhance learning, cognitive activation, and user engagement, the Iberbrain Platform may integrate audiovisual content from different sources.

12.1 Original Content

The Platform contains original content created and owned by the creator of the Iberbrain Platform, which is protected by copyright and may not be copied, reproduced, redistributed, or commercially used without prior written permission.

12.2 Creative Commons Music

Certain exercises may include music distributed under Creative Commons licences or other licences that expressly permit such use. Iberbrain complies with the attribution requirements and licence conditions established by the respective copyright holders.

12.3 YouTube Embedded Content

Some programmes include videos that are hosted exclusively on YouTube, which are streamed and managed by YouTube. The Iberbrain Platform does not host, reproduce, copy, modify, or redistribute YouTube audiovisual content. Videos are displayed exclusively through YouTube's official embedded player.

12.4 YouTube IFrame Player API

To improve synchronisation between cognitive exercises and audiovisual playback, the Platform uses the official YouTube IFrame Player API. The Iberbrain Platform does not download videos, extract audio, alter content, remove advertisements, or bypass YouTube functionality.

By using the features that integrate YouTube content on this Platform, the user expressly acknowledges that the Iberbrain Platform utilizes YouTube API Services. The user further acknowledges that their interaction with the embedded YouTube player is subject to Google's Privacy Policy, Google's Cookie Policy, and the YouTube Terms of Service, and agrees to be bound by them. Any personal data processed by YouTube are governed exclusively by YouTube's own Privacy Policy, Terms of Service, and Cookie Policy.

12.5 Vimeo Content

Videos hosted on Vimeo follow the same rules regarding respect for the intellectual property rights of their respective owners and the terms of that platform.

12.6 Availability of Third-Party Services

The Platform depends on external services (YouTube, Vimeo, cloud hosting, email). If a third-party provider changes, restricts, or discontinues its services, certain Platform functionality may become unavailable without liability on the part of the Iberbrain Platform.


13. Health, Education and Well-being Disclaimer (Medical Disclaimer)

The Iberbrain Platform is designed to promote cognitive activation, learning, movement, coordination, and general well-being. The Platform is intended exclusively for educational, cognitive activation, and well-being purposes.

The Iberbrain Platform does not provide medical services, nor does it provide medical diagnosis, medical treatment, physiotherapy, occupational therapy, speech therapy, clinical psychology, or rehabilitation therapy. Nothing within the Platform should be interpreted as medical advice or as a substitute for professional evaluation or monitoring by qualified healthcare professionals. Users should always seek advice from qualified professionals regarding any health condition.

Participation in any activity is voluntary and must be adapted to each individual's abilities. Children, older adults, and individuals with physical, motor, or neurological limitations must use the Platform under the continuous supervision of a responsible adult, caregiver, or qualified professional.


14. Safe Participation

Users are responsible for participating safely in all Platform activities. Before participating, users must ensure that they have a safe physical environment free of obstacles, an appropriate setting, suitable clothing and footwear, and that they adapt the exercises to their physical and cognitive abilities.

Users must stop any activity immediately if they experience pain, dizziness, nausea, or any unusual symptoms. The Iberbrain Platform may provide additional recommendations through the "Health and Safe Use Guidelines", which complement these Terms and Conditions.


15. User Feedback

Any comments, ideas, or suggestions voluntarily submitted by users may be used freely by the Iberbrain Platform without restriction and without any obligation to provide financial compensation, acknowledgement, or proprietary rights over future developments.


16. Future Technologies and Artificial Intelligence

The Platform may introduce new technologies over time, including solutions based on artificial intelligence, adaptive learning systems, personalized recommendations, or data-driven cognitive insights. These tools are designed for auxiliary purposes, do not replace human or professional judgement, and their implementation will always comply with privacy guidelines and the General Data Protection Regulation (GDPR).


17. Availability of the Platform

While reasonable efforts are made to provide reliable and stable access, uninterrupted or error-free availability cannot be guaranteed. Temporary interruptions may occur due to scheduled maintenance, software updates, security improvements, public internet failures, or technical issues with cloud infrastructure providers, without creating any legal liability or right to compensation for users.


18. Limitation of Liability

To the fullest extent permitted by applicable law, the creator and administrator of the Iberbrain Platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This limitation includes, without limitation: loss of data, loss of profits or business opportunities, service interruptions, or physical injuries, falls, and health conditions arising from the incorrect, negligent, or unsupervised practice of movement and rhythm exercises by users or institutional entities.


19. Commercial Conditions, Billing and Suspension

Access to the Platform may be subject to the payment of subscription fees, institutional licensing, or specific commercial conditions individually contracted in writing with each user or partner entity.

The administrator reserves the right to suspend or cancel access to any account, immediately and without prior notice, whenever there is a failure to meet the agreed financial conditions or well-founded indications of a breach of these Terms. Suspension for non-payment or violation does not entitle the user to any refund.


20. Privacy and Data Protection

Personal data processing within the digital ecosystem is carried out in strict accordance with the General Data Protection Regulation (GDPR) of the European Union. Detailed information regarding the collection, purpose, storage, and erasure rights of data is described in the Iberbrain Platform Privacy Policy and the Iberbrain Platform Cookie Policy, which form an integral part of these Terms.


21. Changes to these Terms

These Terms and Conditions may be updated at any time to reflect technical improvements, new features, or changing legal obligations. The most recent version will always be published on the Platform. Continued use of the services after updates are published constitutes tacit acceptance of the new Terms.


22. Force Majeure

The Iberbrain Platform shall not be liable for failures or delays resulting from unforeseen events beyond its reasonable control, including natural disasters, pandemics, war, civil unrest, large-scale cyber-attacks, general power grid failures, telecommunications outages, or restrictive governmental actions.


23. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by, interpreted, and enforced exclusively in accordance with the laws of the Netherlands (Dutch Law), the country of residence and establishment of the creator of the Iberbrain Platform.

For the resolution of any dispute arising out of or relating to these Terms, the parties expressly choose the Court of Maastricht, the Netherlands, as the exclusive forum, waiving any other court.

Where mandatory international consumer protection legislation applies in the end user's country of residence (such as Portugal or Spain), the statutory rights and local guarantees of those users remain fully safeguarded in accordance with European Union law.


24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent court, the remaining provisions shall remain valid and enforceable in full force. The invalid provision shall be interpreted, where possible, in a manner that most closely reflects its original purpose.


25. Entire Agreement

These Terms and Conditions, together with the "Privacy Policy" and the "Health and Safe Use Guidelines", constitute the complete and exclusive legal agreement between the creator of the Iberbrain Platform and the user, superseding any prior communications, understandings, or versions relating to the same subject matter.

This English version serves as the master reference version for the corresponding official translations into Portuguese, Spanish, Dutch, French and German. In the event of linguistic inconsistencies, each translated version shall be interpreted consistently with the applicable legislation of the jurisdiction in which it is published.
